Morning Report: 3 arrested after shooting into home

Police and Fire: Three people were arrested late Monday night in connection with a shooting into an Oxnard home, police said.

The shooting occurred shortly after 11 p.m. in the 3000 block of South L Street after a 46-year-old woman confronted several people who were vandalizing her vehicle, Oxnard police said in a prepared statement.

After the woman confronted them, the people got into a vehicle that was waiting at the scene. As the vehicle was leaving the scene, it stopped in front of the residence and someone fired several shots into the home.

Officers responding to the scene located the vehicle several minutes after the shooting, police said.

The driver, Victor Franco, 24, of Coachella, was arrested in the back yard of a residence in the 3500 block of South B Street, police said.

A weapon possibly used in the shooting was found in the yard, according to the police statement.

Police later determined the vehicle had been stolen during a carjacking in Cathedral City.

Franco, who is on parole for robbery, was booked into Ventura County Jail on suspicion of carjacking, possession of a firearm by a felon, possession of a firearm with an altered serial number and violating his parole, police said.

Two 22-year-old Oxnard men in the vehicle were arrested on suspicion of possible involvement in the shooting then released pending further investigation.

----------

An armed robbery was reported early this morning in Nyeland Acres, authorities said.

The robbery occurred shortly after 4 a.m. in the 3400 block of Vineyard Avenue, said Capt. Bill Boyd of the Ventura County Sheriff's Department.

Two robbers, a man and a woman, approached a man then took his wallet after one of them pulled a handgun, Boyd said.

No one was injured in the robbery and no shots were fired.

No suspects had been arrested as of this morning.

----------

Traffic: At 10:07 a.m., the California Highway Patrol was not reporting any traffic collisions or hazards on county roadways.

----------

Weather: Forecasters predict cloudy conditions today with a 40 percent chance of rain this afternoon, the National Weather Service reported.

High temperatures in the 60s are expected.

A flash flood watch is scheduled to go into effect this afternoon and last through Wednesday evening for recently burned areas in local mountains.

Good thing they got caught, now put him back in jail, and they shouldn't of let the other two go, there probably going to do it again since they got off easy.

Another example of outstanding police work by the OPD.
Thank you

Franco is headed back to prison, hopefully for the remainder of his life. He may have given a Coachella address, but he is actually a local having been in our courts about 13 times. Public records show convictions ranging from auto burgs, to firearm possession by a felon, to resisting arrrest (twice), false id, no license, refusal to show id, leash law (pit bull?), and several for vandalism, all dumbed down by the DA to misdemeanors.

Law enforcement has supported us admirably, as always. Our court system, however has failed us in that this guy should never have been released from prison.

Back to my usual rant regarding illegit kids that we end up supporting. How many "breeders" does Franco have and how many kids does he have by them? I'm waiting for the usual bangers to come to this site to defend Franco.

Victor Franco, 24, of Coachella
was down here to recruit prospects.
They didn't even know the victim.
GIVE FRANCO SOME EXTRA TIME, and make it SOLITAIRE with NO COMMUNICATION.
He's a "Captain"

Great Work Oxnard PD! Keep up the Great Work!

Equitable_Enforcer ... I really don't appreciate your nasty comments about illegit kids (all of the time!).. you know not all of them turn out to be dumba$$ gang members!

Well said Ms. Cali. I agree that the stereotyping gets old after a while. I am Chicana and my oldest is "illegit" yet he isn't a gang member and is not supported by anyone but me!

"Our court system, however has failed us in that this guy should never have been released from prison."--EqEnf

Did this guy commit a crime in the past that would have dictated remaining in prison? Beyond his sentence? Like a Murder or similar?

Obviously you are merely stating opinion. He isn't a model citizen by any means and his soap on a rope now has another noose in it.

maybe we should spay/neuter them? Just a thought...

Ms_California and noonespecial, I have yet to see one of these bangers who didn't have a breeder. There are tens of thousands of them in Southern California alone. My concern is not one of morality, but one of social consequence. Most of those kids do not grow up in the best of environments and we who pay most of the governmnent's bills end up supporting them. Personally, I'd be for sterilization of bangers and their breeders.

Thank goodness for OPD catching bad guys. If this would have happened in ventura they would have all gotten away like the other night. Pathetic!!

nojustice_justus, Franco had already demonstrated by his conduct that he didn't deserve to live among legal, law abiding residents. He is a plague to society and a danger to others as long as he is not behind bars.

Is it just me or is violence getting worse everywhere?

Posted by noonespecial on November 25, 2008 at 1:39 p.m. (Suggest removal)

Equitable_Enforcer I appreciate why you feel the way you do, in fact many people agree with you. My point however, is that not all children born into the gang lifestyle are supported by welfare or grow up to bang. My ex (note the ex part) is a gang member (which I guess by your standards make me his "breeder") however, like I stated previously, my teenage son does not bang nor do I rely on public assistance to support him. I also have friends (you would refer to as "breeders") who support their children and teach them right from wrong and know many gang members who were raised by both of their California born parents. Therefore, I feel the stereotyping is unfair and the reasoning behind it, incorrect.

NoOneSpecial -- we're thinking YOU are the exception to the RULE -- statistics are not in your favor -- I'm very proud of you for getting away from "him" and raising your boy right -- I raised my two kids ALONE financially, spiritually, physically, etc. -- no easy task that! My son went stupid for a short time regardless of what I taught him -- the streets tend to dictate the children's actions and our streets are looking really bad these days!

Posted by nojustice_justus on November 25, 2008 at 1:57 p.m. (Suggest removal)

More people equals more crime. You can throw the 'per capita' statistic around as much as you would like, but crime is going up.

Hopefully it is a linear ascension and not exponential.

Oxnard is at 200,000 citizens plus the undocumented (maybe 50,000?). One would think they have the most crime as they are the largest city in Ventura County.

Wow, the lady was kind of gutsy for confronting them. I'm glad that OPD caught these creeps...3 down, way too many to go!

Posted by noonespecial on November 25, 2008 at 2:54 p.m. (Suggest removal)

lawabider I agree that I probably am an exception to the rule but I also feel that the negative stereotyping does nothing to help girls who may want out but don't have the support or the self esteem to make a move. I feel instead of judging, and referring to them as “breeders” we should be letting single mothers know they can do it alone.

ILUVOXNARD2 I met my ex when I was 16. At the time, I was caught up in a lot of stupid stuff myself and thought nothing of kicking it with a guy that banged. He was fine as hell (I still think he's sexy) but I knew I had to leave because my little boy deserved better. It was hard but I was one of the lucky ones, I had the support of my family. To this day, I tell my son that he was my lifesaver. A lot of people feel that being a teen mother is a bad thing but, if I hadn't had my son when I did, I know I would have been dead or in prison by now.

I'm with you, Equitable Enforcer. However, instead of blanketing blame on our court system, perhaps it's time we put some heat on the District Attorney's office specifically. Our prosecutors seem to contribute to the "revolving door" nature of our county courts system by passing up opportunities to seriously punish the repeat criminals that overload it.
In this case, the person(s) responsible for shooting at the brave woman's home probably won't be charged with anything more serious than vandalism because, as we've learned, bullets aren't capable of injuring or killing if they're not specifically aimed at someone. When we allow these repeat offenders to continue endangering innocent people's lives time after time - not to mention the costs associated with their mindless acts of vandalism - we shouldn't be surprised by their frequent appearances in our county courts for increasingly brazen crimes. To me, assault with deadly weapon, witness intimidation and gang enhancement charges, along with appropriate vandalism counts, should be pursued vigorously.
Earlier this year, I was the "victim" of a strong-arm robbery, during which the perpetrator and I scuffled in the middle of a busy city street in broad daylight. He got away with my wallet, but was quickly apprehended, arrested and jailed (thanks OPD!). Our encounter was not a simple pickpocket case, but very-well could have resulted in serious injury, and I shudder to think of how an elderly and/or infirm person could have been hurt in such an incident. Shortly after, an arresting officer told me the robber's record included a "strike" for conviction of a violent crime, among several other convictions. I was assured that he faced significant prison time for this second strike. Months later, after several negotiating sessions, the perpetrator pleaded guilty to the robbery. The second strike made him eligible for a 3-year sentence, and I was told he would need to serve the full term.
However, at his sentencing, the judge announced that with his guilty plea, the DA's office had agreed to reduce the robber's first strike to a "non-violent" offense. Therefore, my case was classified as his first violent crime, and as a result, he was sentenced to 2 years. I was told that with his two months in county jail before sentencing, along with time off for "good behavior", he'll probably be prowling our streets again within a year. With his lengthy record of drug-related offenses and violent nature, I believe he's a danger to society, and I worry that his next crime will result in serious injury - or worse - to an undeserving person.
The "tough-on-crime" conviction rates annually trumpetted by our DA's office squawk rather tinny to this one "statistic." My case was a missed opportunity for prosecutors to remove one "player" from the legal merry-go-round that's costing taxpayers millions of dollars each year, and endangering the lives of us law-abiding people as well.

ILUVOXNARD2, you asked the question I wanted to ask. In restaurants, on the streets, in the malls, I see bangers ... ugly, tatooed, shave headed, baggy pants bangers ... with pretty young women, some Anglo, some Hispanic but all too often dragging one or more kids. We see women try to get away from them only to be brutalized due to a Machismo attitude that holds women out to be property. They can be doing multiple women, but an ex breeder is not free to have a new relationship.

noonespecial ,Thankyou for your honest answer....Although you didn't have to comment back on it. My daughter also was in love with a gang banger......Thank God that ended. You sound like a very intelligent woman!!!!
Its the DA that decides to press charges and decide felonies from misdemeaners. My Son got totally scr**wed in court. And yes he got a strike and is now a felon. I guess you can't protect yourself anymore against five gang bangers! I hate the court systems......I beggged him to plead not guilty but they scared him telling him he would get up to 8 years! So he took the plea deal.........what a mistake ! I wanted to go to the Newstations also. This was so unfair. I think alot of DA's have thier head up thier A**. He did prison time, then got out and did really good and still is as always. And got full custody of his baby....
When you go to court you just never know how they are going to trick you in how to plead. I wonder if there is a way to get the strike taken off? Didn't feel at the time we needed an attorney ,since it was sooooo obvious he was innocent. Big mistake on our part I guess.
