Man arraigned on child endangerment charges

A Simi Valley man pleaded not guilty Tuesday to felony charges involving child endangerment and possession of a firearm and ammunition.

Daniel Varola, 24, appeared before Ventura County Superior Court Judge Edward Brodie, prosecutor Rachelle Dean said.

It was the second time Varola has been arraigned, and was necessary following a May 12 preliminary hearing where he was held to answer on the charges. His first arraignment was April 29.

The charges include two counts of child endangerment, three counts of possession of a firearm by a narcotic addict and possession of ammunition.

The judge set a pre-trial conference for June 18. Varola is out on bail.

In April, two children were treated for heat exposure after they were found strapped in their car seats inside a closed vehicle about 11 a.m., police said.

When officers arrived at the location, they found a 2-year-old girl and 1-year-old boy inside the vehicle. One of the people who had notified police had opened the vehicle by the time officers arrived.

Police said they found the children's father, Varola, at a nearby business.

Some people do not deserve to have children. I think he should have been drug tested because I can’t believe God would make such a stupid human being.

It is such a shame that such stories can be printed. A bunch of lying cops that want to get ahead, violate civil rights and make up charges over someone stepping away from their car for under 10 minutes. I cant wait till we get to print our story on how corrupt the simi valley police department is. a good loving family doesnt deserve this

oh and by the way- you are considered a narcotic addict if you get in a car accident and are prescribed vicadin. Crooked cops- crooked system

I'm sorry kidsmother, but 10 seconds away from your car with your 1 and 2 year old strapped in it is 10 seconds too many! Take your kids with you or get a babysitter, it's that easy!

They dont even have the age of the kids right...and did I say what he did was right? no- he served his time and is doing what he needs to do. They failed to mention anything good and are highlighting and exagerating the bad. These cops should be ashamed of themselves. They already got caught on stand lying. Oh and by the way- have you ever left your children in the car to pump gas...same thing- that is a felony right there. The kids were not rescued and this was right next to the hospital and my husband came out while the cops were pulling up. The tow company was called before he even walked away from the car.

You people are such sheep. You believe everything you read and start insulting me. I am disabled and was in too much pain to get the kids out of the car (my neighbor helped me get them in the car). I had to run into my doctor's office to get my medicine. A parking enforcement agent decided to play hero and called the cops as I walked from my car. The cops were called at 11:02 am and arrived 3 minutes later. I walked out and approached them at 11:09. The windows were rolled down and it was about 70 degrees outside. The doors were locked so nobody could snatch my kids from the car. I admit it was a stupid mistake and I have suffered enough from this, trust me. Here is the kicker though. I watched my children be pulled from the car and they were laughing and smiling. They were taken to the hospital where the staff said that they were fine and it was unnecessary for them to be treated. My wife was called from work to the hospital. They immediately accused her of being a drug addict and wouldn't let her hold the children. They said they were going to take the kids away from her unless they could do a search of our home. They put her in the back of the cop car and drove her to the home. They said they were doing a health inspection but didn't search the kids room or anything. They went straight for my room and searched it where they found my LEGALLY bought firearms that were locked in my range bag out of the kids reach. They yelled at my wife until she had broken out in hives from being so upset and stressed. They told her that I left the kids in the car for over an hour and that she needed to divorce me otherwise she would never see her kids. When she was at the house crying, stressed, and afraid the cops got a phone call from the hospital saying that the officers at the hospital had left the kids there and there was nobody available to watch the kids (also they were very upset and crying). The staff said that my wife needed to pick them up and the cops told them no, that they needed to search my house first (which is not their job, CPS is required to do this for this very reason). After over an hour of my wife and kids going through this ordeal she was finally able to reunited with our children. Now re-evaluate this situation now that you have heard the truth. If ANYTHING the cops should be the ones in jail for child endangerment. They put my kids through a very traumatic experience over 6 minutes. My wife has suffered post traumatic stress syndrome and has had to be treated by several doctors. She has also almost lost her job over this. So now we are struggling to keep our home, cars, and everything else. This county has put my kids in danger of being homeless which in my opinion is a lot worse than what I did. Just this morning I saw several people at the gas station and the ATM leave their kids in the car for longer than I did.

I'll bet he is a good dad. Does he let the kids play with the guns too?

Also I'd like to say thank you to this paper for printing a one sided story. My business has gone under because nobody wants to do business with the person portrayed in this paper. I really hope they have checked with their legal department about this because the amount of potential income that I have lost in very substantial and I would really hate to see this paper shut down.

I can't even get a job at a grocery store because of all of this. So tell me how is my family supposed to survive?

It seems to be that this county has such a bad deficit that they need to do things like this to collect YOUR tax dollars. People should be outraged about this because I'm not the only one. I've met several people in jail that have been fighting cases like this for over a year because they can't afford private council. The public defenders just bounce back and forth with their buddies at the DA's office so they can all get paid.

PATHETIC.

Ms_California,

You are a very intelligent person. You should visit the 2600 block of Jones Way and see what types of businesses are there. If you weren't so ignorant you would have read the other article, looked at the address and realized that they don't put strip clubs and liquor stores next to hospitals and doctor's offices.

Legal_American,

I was drug tested. I came up positive for the medication I was given by my doctor. I need to have back surgery.

Is this all you people do is read articles in the paper and comment on them without knowing the actual facts? You all need to get a new life and ditch the sad, pathetic one you are already living.

Barola, sounds like you have a good excuse for everything. I have a feeling you are preparing yourself for a law suit, all because of your negligence. I really don't think anyone is going to be homeless. Why could you not wait until your wife got home to get your medication? And most people go to a pharmacy to get their drugs, not their doctor. Someone is lying here. And yes, people like reading this stuff because they can not believe that there are such idiots like you in the world.

I'm sad to hear of the situation but as a mother/grandma I think we are all forgetting 1 thing, the babies. The situation should have been handled much different but again, those babies are the most important thing here. Dad should have had the neighbor that helped put those kids in the car just watch them for the few minutes he was going to be gone, and I don't care what type of meds your on, don't get behind the wheel of a car and not only put your life in danger but those of my family. You have every right to be indignent for the way you were treated but once again, who were you thinking of when you got out of that car, the babies? No, you were thinking of you and your needs. NOT COOL - Put it all together and it comes down to one thing, a family is torn apart and the key element once again was DRUGS. I don't believe the house, the gun or any of the other stuff should have come into play but if you have a problem, and you do, you put your addiction ahead of your family and for that one action you have now created one of chaos - before you do or say one more thing about your injustice, do me a favor and think about those kids. Maybe its time to get the help you need or walk away until you can. Give your family a chance to heal. Seems to me like you hold yourself higher than you do those kids and your wife. Shame on you and the system too!

Look- he made a mistake and paid for it. The kids are fine- thankfully nothing bad happened to them. They didn't suffer from heat exhaustion or exposure, they were crying cause a stranger took them out of the car. I didn't even need to do a followup with their drs cause they weren't hurt. The accusations need to stop because he is a good father and he made a mistake that millions of ppl make a day. Before you throw around what he should have done and who is lying, maybe you should stop and think about ALL the possible options out there. There isnt one way to do everything. Did anyone stop to think that maybe there wasnt anyone to call and maybe we are a family that lives paycheck to paycheck and maybe the medication was of a special nature. No- because people read a story and think worse case scenerio and start pointing fingers. It is a shame that someone has to hear such rude and horrible things said about them and from people that have NO IDEA. An injustice was done- and all over something that was a mistake that millions of people make a day. We understand that a mistake was made and the family has been punished enough. Everyone needs to move on with their lives and stop being so judgemental. That is what is wrong with the world.

Kidsmother......it is illegal to leave your children unattended in a vehicle period. I love the comment about how safe your children were, the doors were locked but the windows were open. Yeah that will stop someone from kidnapping your kids. God forbid if that happened because I am sure that would also be the corrupt cops fault. By the way there is a reason for the warning label on the bottle of Vicodin. IT IMPAIRS YOUR ABILITY TO DRIVE!!! Thank god he didnt kill someone while he was driving around high on Vicodin but if he did I am sure that would have been someone else's fault as well.
