An Oxnard police officer who was accused of raping a 12-year-old girl at a police storefront two years ago will not be charged with a crime, the Ventura County district attorney announced Tuesday.
Before the more than yearlong criminal investigation against him was concluded, Senior Officer Martin Polo quietly resigned last month after 20 years with the Oxnard Police Department. He had been on paid administrative leave since last summer.
"Despite exhaustive investigation into this matter, insufficient evidence was uncovered to establish beyond a reasonable doubt that the alleged offense occurred," District Attorney Greg Totten said in a written statement.
"Allegations involving sexual abuse of a child are serious and are always thoroughly investigated regardless of a person's position or occupation," the statement continued. "The investigation of this matter was thorough, far-reaching and in keeping with the highest standards for the investigation of crimes against children."
Polo could not be reached for comment Tuesday. When contacted previously, the 43-year-old Oxnard native said his life had become a "living nightmare."
Polo's attorney said his client "adamantly denies any wrongdoing."
A deposition the now 14-year-old girl gave last week was "full of inconsistencies and frankly, in my view, defies credibility," said Steven Rothans, a lawyer with the Los Angeles firm of Carpenter, Rothans, Dumont.
No details on resignation
Polo resigned for reasons unrelated to the criminal allegations, Rothans said, without providing further explanation.
The girl, who reportedly suffers from emotional and mental problems, is now being cared for at a private facility in Utah. The Star has a policy of not identifying victims of alleged sexual crimes.
Despite Rothans' assessment, the girl's statements during more than 10 hours of questioning over two days were on point and consistent, according to Etan Lorant and Yeal Trock, attorneys for the girl's family.
The attorneys were also confident they had a strong civil case. The family has filed a $10 million federal civil lawsuit against Polo and the Oxnard Police Department.
"The DA must use a stricter standard of proof than required in her federal civil case and we strongly believe that we can comply with the civil standard to prove the child's case," Trock said.
The girl's attorneys also questioned why the district attorney said in the one-page written statement that the girl alleged she and Polo had "consensual intercourse." By legal definition, sex between a man and a 12-year-old girl cannot be consensual, Trock said.
"And she did not want to have sex with him," added Lorant.
DNA didn't match
The investigation into the girl's allegations included searches of Polo's home, his personal computers, car and the police storefront at 3749 W. Hemlock St. Investigators were unable to match DNA from the storefront and the girl's clothes to corroborate her allegations.
"Once the Oxnard Police Department became aware of the allegations, sexual assault detectives from the police department worked closely with the district attorney's office and conducted an extensive, yearlong investigation," according to the district attorney's statement.
On Tuesday, authorities revealed that the girl reportedly ran away from home the day before the alleged rape. Polo found her and took her back to her mother's house. The next day, she ran away again and then called Polo, who picked her up.
The 12-year-old said Polo took her to the police storefront, where they engaged in "consensual intercourse," according to the district attorney's statement.
While investigating the criminal case, Oxnard police uncovered allegations that Polo, his former partner, Senior Officer Frank Brisslinger, and an unnamed officer used the Hemlock storefront for sexual encounters and to take pictures of scantily clad women, according to Oxnard Police Chief John Crombach.
Although those allegations did not involve criminal misconduct, they did involve possible violations of department policy and conduct unbecoming an officer, Crombach said.
As a result of that inquiry, one officer resigned in lieu of termination, while Brisslinger remains on paid administrative leave, he said.
Chief closes storefronts
When the allegations surfaced, Crombach said his department quickly and thoroughly investigated the matter.
"We took this very seriously, and I appreciate the DA's comments," he said. "We did an exhaustive and far-reaching investigation with their involvement."
Since the matter became public, Crombach said, he has closed the Hemlock storefront and is in the process of closing several others.
The department has nine storefronts throughout the city, but Crombach would like to winnow those down to four because many are not being used. He would like the ones that remain open to offer a fuller range of police and neighborhood services.
Throughout the investigation, Crombach said his department has continued to do its job.
"We've kept our heads up and kept moving forward," he said.

Well I guess this isn't front page news anymore. It's obvious to me the Oxnard PD is on a witch hunt for something that did not occur. Not only have they wasted a lot of money on this investigation, but they have made Officer Polo out to be the bad guy, when in fact he is not. The DA is a big fat lier when he says his office investigates stuff fully. The only reason they didn't take this to court is they new they would lose ad that looks bad on them. It's nothing more than a game they are playing, and it's unfortunate these officers got caught in the middle. The Star and Oxnard PD should be ashamed of themselves for posting Polo's picture.

So Oxnard PD loses a good officer and it turns out nothing happened. The allegation was false.
Who didn't know that already? A 12 year old mental patient cries rape and a good career is ruined.
I love how the attorneys for the girl say that the D.A. has a higher standard that they must meet, but in federal court they don;t have the same standard. How wonderful for the citizens of Oxnard. The attorneys can SLIDE this one by on a weaker standard of the truth.

I am glad that the DA did a through investigation and found the allegations to be unfounded. The OXPD has no recourse but to investigate Officer Polo when allegations were brought about by the alleged victim. I would like Martin Polo to file his own lawsuit against this family. The defamation that has been suffered to Martin is terrible, Martin should also be compensated for the "hell" he has had to endure. I feel for the young girl, she was just a pawn used by her family. Keep in mind she had been a runway...that means she wanted to get away from her family. Did protective services investigate the family? Are there any more children in this household?
As for the picture, who know who posted it, accordiing to the Officer's Bill of Rights it had to be with his permission, doubt if he gave the press the okay. Sometimes the press has pictures in their archives, I doubt the OPD gave them the picture.
As for the internal investigation of the other officers, that should have remained "internal", OPD should investigate who leaked this information out. Everything handled by a police entity should be kept confidential, I don't think any of us would like to have our reports shared at the dinner table of the city employees.

You guys are a joke, Good Officer. He has cost tax payers millions, plus he hasn't even worked 6 months in the past two years because of paid leave. If you think he is a good officer, then you have more mental problems then the 12 year old girl. He has shown poor morals, first by being a 40 year old man who left his wife for an 18 year old. PERVERT. Second: by cruising the beach (the claim they made about protecting a swimmer was a lie, the swimmer himself and witnesses said that he was not in any danger, nor appeared to be in any dainger, and if that was the reason, why didn't they even leave the vehicle) he and his partner ran over the sunbather. Third: if the allegations were not true, why did he and another accused decide to resign. If the other officer was not involved in any wrong doing I doubt he would have resigned, instead he would have fought these allegations. They do have enough evidence to fire him and the two other officers for taking dirty pictures at the sub-station. That is why the other officer resigned. Do you think that taking dirty pictures while on duty is OK? Fourth: he is no longer a police officer (resigned: about time he should have resigned when he murdered that lady) so his so called right to keep his picture out of the paper is negated. Its people like you that dont hold authority to a higher standard, and this is why we have corrupt police officers, politicians, security guards, and towing companies. Another thing this should not be internal or confidential. They are public servants who are paid ($80,000 per year) by mine and your tax dollars. I have a right to know where my tax dollars are being wasted, or used. You all are just trying to protect your friend. Ok, I have to play "devil's advocate". What story are you people reading!? Just because the DA did not seek prosecution does not mean that these allegations are untrue or false. They failed to find evidence that would indicate "beyond a reasonable doubt" that a crime had been committed. That is what it takes to convict someone in our justice system. Did something happen between Polo and this young troubled girl...probably. The fact that she says they had consensual sex is telling. She is not really crying rape. It is her age that makes it a rape. Only two people really know. It will be interesting to see what comes out in the civil trial...or if it settles before a trial.
I am not going to judge Polo either way. Just let this be a lesson to other officers. Don't put yourself in a position where you are vunerable to allegations like this. A male officer should NEVER be alone with a female victim or suspect. Especially when transporting them. Always have an escort and give your starting and ending milage to dispatch.
Lastly, police officers have committed rapes, murders, and other heinous crimes. It is not uncommon...so don't discount something just because of the occupation of the accused, regardless of how well you think you know them.

Corruption in a Police Dept is nothing new. Corruption in Ox PD is nothing new. This was a blatant witch hunt on Polo and Brisslinger. These two men were unfortunately involved in an accident that brought the national media to Oxnard PD. Someone needed to be held accountable.
Was it just by chance that these allegations were brought foward against only these 2 men after the accident?

OK so what your saying oxnard40 is that the 12 year old girl chose to accuse these officers, because she wanted retribution for the Slain sunbather. I doubt it. And if your implying this is a set-up by the Police Department to rid these guys, then you must think that Aliens crashed at Roswell as well. Keep reading your conspiracy theory weekly, and keep coming up with wild fiction, maybe you can write movies one day. There is not a conspiracy going on about these guys, chances are they are bad cops, more than the chances are that this is a highly organized conspiracy to rid the department of two officers who have given the department a lack of credibility.

If an ordinary citizen had been accused of raping a 12-year old, that citizen would have been thrown in jail immediately. Why was Polo allowed to remain free, and on paid leave?
I do not know whether he is guilty. I am making no accusation against him or the OPD. I just question why he wasn't arrested and incarcerated.

I just think that it was ironic that the 2 officers that brought so much negative attention to Ox PD, just happen to be involved in sex scandals at the sub stations. Who else was invloved? I find it hard to beleive that Polo, Brisslinger, and "Unnamed" were the only cops involved.

If anyone else had run over a pedestrian while using very poor judgment, they would probably have been charged with vehicular manslaughter, If anyone else had been accused of rape, they probably would have been held in jail.
I think that we should raise the pay for Police Officers, that way more candidates would apply. Hold officers to higher standards, but pay them for the authority they hold. My experience with some of OXPD officers has led me to believe that they are under educated, use poor judgment, and have a lack of responsibility. If their position was in the public sector, they would not work long. One example I saw an OXPD officer on a Motorcycle parked on the sidewalk, during high pedestrian traffic, he was hidden, so he could catch speeders. My first thought was "isn't the sidewalk reserved for pedestrians". And as he chased off after a driver, the police officer nearly hit a pedestrian, had the pedestrian been deaf or blind, and had not stopped in his tracks, there would have been an accident. I don't understand how you can break a law to prevent crime. Isn't driving on a sidewalk much more dangerous then speeders?

Wow, did you read the DA report? Do you have some inside information? I did not, I was commenting on the fact that the DA did not file charges. You are right, he is my friend, along with many other officers. Ashamed? of what? He wasn't even charged...did you actually read the paper? I am sick and tired and those few indivuals who are "cop haters" that use this site to rant and rave, spewing hate for the men and women that protect the City of Oxnard.
Those who know me know that I do hold these officers to a higher standard, but crucifing them before they are judged is hurtful to all concerned. Did you ever consider the officers resigned because they were overwhelmed and just holding on to what was left of their lives.
They are paid "public" employees, which means they do in fact work for the public sector. They are intelligent men and women, before you start call them "uneducated" I suggest you take the police entrance exam. I don't condone immorality, neither do I condone any law breakers. I happen to believe that an individual should be allowed the respect pending any investigation. I refuse to address anyone's private lives, because I live in a glass house, I will not throw any stones. Maybe you are perfect and have never met anything in your life that has caused you any regrets. If so you are blessed.
They are infact public servants, their wages are paid by home owners in the City of Oxnard. Just like the public ,that they serve, they too have rights...like I said before they are public servants not serfs.

I already thanked the police yesterday (both by phone and email) for the excellent work they did investigating predatory towing, and I am a member of our neighborhood watch. Your comment has no bearing on the fact that this cop is not a good one. I applaud officers of the law all the time, however, I do not agree to give them any remorse or special treatment when they break the law, or use very poor judgment. And by the way I am glad you moved out of Oxnard myself, we don't need any more whining complaining citizens, who fell they need to protect a police officer, who has cost tax payers millions in his mistakes. If you want to spend millions on your local police enforcement to keep making mistakes, I am glad your vote will not count in Oxnard. I will not tolerate police officers, city council members, district attorneys, trash collectors, etc. who continue to cost tax payers, because they can not use good judgment, or are too stupid to follow directions. POLO is an example of a city servant who has, tarnished our OXPD, and cost millions of dollars by using poor judgment numerous of times. So this guy needs defense from only one person, an attorney. Are you his attorney?

I am crucifing him because he has already made mistakes that have cost taxpayers too much money, and he continues to use very poor judgment. A smart person learns from their mistakes, and does not continue to make mistakes based on poor judgment. I dont hate cops, I hate people who use, lie, and cheat our citizens out of our hard earned money. By the way wasn't Polo also investigated for lying on the stand?
Here is a list of his mistakes, you tell me if you would hire him as a police officer.
1. Lying on the stand.
2. Running over sunbather, while cruising the beach, unauthorized and untrained.
3. Being left alone with a female minor, who accused him of having sex with her.
4. Divorced - For having sex with a 18 year old when he was 38 (I know this is not against the law, but come on he is old enough to be the girls father. This tells you that he was willing to risk his family for teen sex, this speaks volumes about his character and tells me he has issues with teenagers and sex. duhh)
Maybe the 3rd mistake is an accusation, however the first two are not, and he kept his job? If I lied to my employer, or hurt someone on the job, I would be fired, so he is not held to a higher standard, like the rest of us who pay his salary.
Honestly your comments make you look like someone who accepts, rapists, murderers, and liars. Is that how you want to represent yourself?
We have Police to arrest rapists and murderers, not to become them.

Holdenon-2000 reference # 1 he never lied on the stand...in fact he aknowledged his attempt to withhold information during questioning...it is permitted through 1041/1042 of the evidence code...he tried to concealing the identity of an informant...this was not only done with a supervisors consent, but later told to keep his mouth shut...It sounds like you have bits and pieces of what you have convinced yourself to be true...only those in the inner circle know the truth... # 2 he was not driving...how often have you jumped on the drivers lap to take the wheel....it was an accident and subsequently determined by all investigative parties an accident...# 3..need I say more...like I said before...depositions...I have a feeling plenty will be learned!

One word, VINDICATION! I am so glad these allegations turned out to be just that, allegations. Unfortunately the STAR and all these OPD haters have already turned the world against Polo and the OPD. And if OPD is so corrupt, ignorant, use poor judgment and have a lack of responsibility then dont call them when something is happening to your house, car or children because they may just send one of the bad ones. Just shut up Holden. I really hope Polo sues the Star and the girls family for ruining his good name and 20 year police career for defamation and false allegations.

holdeon- Polo was not the driver in the sun-bather incident so why do you continuously bring this up? Do you think he coerced his partner into running the woman over?
Leave the guy alone. His career is ruined, his family life most likely has some strain and who knows what else.

This officer should be able to sue the city and the girl's family for quite a bit. The allegations were unfounded, as predicted. No evidence=no crime. DNA evidence is hard to argue with. She obviously had sex with someone, but not the officer. A mentally troubled teen made-up a story to hide what she did as a runaway; nothing more.

Mr. Holden, How can you make such accusations to my character by my statements pertaining to Martin Polo not being charged with any crime.
1. Martin Polo has been vindicated by the simple fact that he was not charged. Therefore "NO RAPE" was committed.
2. The tragic death of the sun bather (forgive for forgetting her name) was a horrible accident and Martin Polo was not driving.
3. Your statement of sequence in the minor being left alone with an officer is in correct.
Keep in mind that Martin Polo was not charged with any crime regarding this victim.
4. Everyone is entitled to their own privacy I refuse to comment on this matter.

I am sure that if any of these "allegations" had happened to you in your line of business, you too would be allowed to defend yourself against these allegations before any "firing" occurred. I bet it would not be public knowledge either. Just because your taxes pay their wages does not mean they don't have the right of privacy until the final determination.
This is how I represent myself, I believe our justice system is based on "innocent until proven guilty" and that's how I see things. In this particular case Martin Polo has not even been charged, get it. He did not even go to court! He has been labled by the "court of public opinion", defamed, accused unjustly as a rapist, murderer, pedophile, you name it, you have said it. How dare you make such a statement as :"We hire Police to arrest rapist and murderers not to become them". No one was charged with those crimes....
What I do not appreciate is people who embelish their statements with inaccurate information to try to prove their point. I do not condone ANY crime.

But for the grace of god probably any officer could be subjected to malicious, false allegations of misconduct. It isn't anything I would wish on any officer.
One has to go through a very thorough background to become an officer. Unfortunately, like any other profession, some don't ultimately have the character the profession demands. Police Officers are held to a higher standard of personal behavior than the private sector. An Officer lies, he will be terminated. Would that happen always in the private sector, I doubt it.
But at the same time they are also protected by the Police Officer Bill of Rights, which at times ,to law enforcements detriment, protects officers who should no longer be in the profession.
Rarely do officers ever resign. Generally it is because it is the option to being fired.
Who knows what came out of that internal investigation and how far ranging it was and what Polo said or didn't say. I can't believe a 20 yr. veteran would just resign. If anything wouldn't he go for a retirement.

All together, has anyone thought of how this all came about as a whole? How can it be said that it's a personnel matter with one officer (who no longer works for the department)and then there's one officer (Brisslinger) out on stress and one officer Polo taking the majority of the hits in the media? Seems there's a GIANT mole on the inside. If you talk about one, you should talk about all. If you are going to air dirty laundry, you better make sure yours is clean! Like Gramagracie, I'm not here to judge and I thank my lucky stars I don't have to rely on anyone here to judge me.
Oh, I'm sure I'm going to take some nasty responses here, but go ahead, it doesn't bother me one bit. I'm not going to get upset one bit. But if I make your blood boil just enough to respond! I'VE WON BOZO!
roger - he resigned because a good officer never recovers from accusations this serious. It takes its toll on a person and besides being a good officer, he is still a human being with feelings just like anyone else.

The Oxnard police dept. is the biggest cause of crime in oxnard. Polo is a corrupt cop and so is the majority of the officers on the force, i have to also say WOW thats a surprise that the D.A. couldnt find enough evidence anainst an officer that is put in a position of trust to be found on the wrong side of the law. this is done for the people that believe blindly in the justice system and wont question complaints against officers! Wake up and see what this is more uncovering of truth...i was told many times by oxnard police that my name comes out alot for various crimes SO IT MUST BE TRUE! "WELL I SAY THERE SEEMS TO BE ALOT OF NEGATIVE SAID ABOUT THESE OFFICERS SO IT MUST BE TRUE!" How does it feel M.POLO, F.BRISSLINGER and i'll go out on a limb and say all OPD! GUILTY IS WHAT I CANT WAIT 2 HEAR FOR YOUR LYING EVIDENCE PLANTING CHILD MOLESTING SELVES!!!

Tell us how you really feel! I have a few points to address;
1.Your name is mentioned in alot of crimes.
So "what" must be true? What division, Major Crimes, Robbery, Domestic Violence, Petty Theft, Traffic.....
2.You should thank your lucky stars that we believe in Lady Justice with a blindfold on her face. Considering your name comes "up" alot.
3.I agree with you on one point, the OPD is responsible for alot of crimes, because their hands are tied in enforcing the little darlings who terrorize the fair City of Oxnard.This is due to having to deal with Politically Correct agenda set out by the public arena.
a. Can't go after the gangstas because that would be racial profiling...duh! Oxnard's gangs are... shall we say hispanic. I say zero tolerance but again can't touch the little darlings.
b. Domestic violence victims are afraid to go through with their case, leaving the OPD once again with their hands tied.
c. Family members who know that their loved ones are criminals refuse to cooperate with law enforcement.
I could go on but it would probably be of no interest to you. You want OPD to fail...who will you call when they come for you! The Ghostbusters...because the boogie man looks real scary in the dark. Doubt if anyone has what it takes to Protect and Serve like the men and women you hate so much.
Of course I would not let anyone babysit my grandchildren if they were in fact tried and convicted of child molestion...not the case here..dude/dudette.
I don't believe in karma but I do believe you reap what you sow...if you continue to hate your brethern you are going to be in trouble with the Man upstaris...his commandment says "Love your neighbor as you love yourself". Seems to me you don't love yourself very much.

oxnardsmostwanted has no clue regarding how many officers it takes to protect the City of Oxnard. Maybe Oxnard needs a little bit more officers so that oxnardsmostwanted will have his own little bed in the county jail...or prison..depending on the crime his name comes "up" alot "in".

So this twelve year old girl made this all up. It's kind of funny how she called him to pick her up and he didn't take her back home. Hmm. . .how did she get his number. Just slipped her a card, hey if you run away again give me a call. ? ? ? Also after 10 hours of questioning her story still lined up.
Why would he resign if he was innocent? That is a guilty act, isn't it. Just because you get accused of a crime doesn't end a career. It happends all the time, wrongfully arrested. Hello. everyday.
Why would he take her to the storefront and not home? Isn't she a minor, if he was going to take her to a holding center why not the juvenile hall or the precinct until her parents picked her up. Doesn't seem like they were going to charge her for running away.
To me another perfect example of protecting their own. I hate cops; over rated, over paid, and commit more crimes then the average civilian.
Can't say Sheriff's department will do any better. A bunch of drunks that start fights and laugh about it. Or am I the only one that remembers those incidents as well.
