Sexual assault, gang cases against 3 men are upheld
A state appellate court in Ventura this week upheld sexual assault and gang cases against twin brothers and their cousin stemming from the 2004 rape of a 15-year-old girl in Thousand Oaks.
The Court of Appeal, 2nd District, Division 6, in Ventura rejected several claims by Alex and Albert Albillar and their cousin, John Madrigal, including that there was no evidence to support gang enhancements added to rape and other sexual assault charges.
"Substantial evidence supports the jury's determination that the crimes were committed for the benefit of or in association with the Southside Chiques," wrote Associate Justice Kenneth Yegan.
In September, the three Southside Chiques gang members received long prison sentences for raping the girl at a Thousand Oaks apartment. Superior Court Judge Edward Brodie sentenced Alex Albillar to 24 years and four months, Albert Albillar to 20 years and Madrigal to 19 years and four months.
They were found guilty of forcible rape in concert, forcible digital penetration in concert and street terrorism as gang members. Part of each defendant's sentence — 10 years — came because they were found guilty of street terrorism involving the Southside Chiques gang.
Albert Albillar was also found guilty of having unlawful sex with another minor, a 14-year-old girl, the same day.

I think the headline's use of the term "3 men" is misreprenstative. Perhaps they could have used "Tres Loco Perros."

Before they are allowed out of Prison they should be Castrated...not chemically...physically castrated. This way we can reduce the number of defective offspring these losers would have had. I am hoping that Big Bubba will be thier roommates.

Well, we will see how they fair in prison. Most prisoners don't take child rape too lightly. Those are the ones that usually get killed or become the rapees... don't drop the soap boys!

How come criminals who commit sexual crimes get less time than murders? They kill the victims mentally halfway physically, and all the way emotionally. Not to mention its normally a child as the victim.

While I'm glad they received such long prison sentences, if it wasn't for the gang activity they would have gotten ten years less. Three men gang raping and sodomizing a 15-year-old girl should have gotten those sentences for the rape alone.

I see alot of people here are for rape. As long as its not in your backyard huh? Rape at no time anywhere is exceptable. This man will surely live a life of hell. But think about all these prisoners now that are up for parole soon that you want to become rapist????
