School shooting suspect's lawyer may seek change of venue

The attorney for a 14-year-old boy who is charged with the murder of a classmate at E.O. Green School in Oxnard said he will consider filing a change-of-venue motion because of publicity the case has drawn.

Attorney Brian Vogel said this is a "routine consideration" by lawyers defending criminal cases that generate a lot of media coverage.

Vogel, whose client Brandon McInerney of Oxnard recently turned 14 years of age, said the case has drawn "tons of press" coverage after the killing of 15-year-old Larry King.

King was shot Feb. 12 and was pronounced brain-dead the next day.

Vogel said a handful of considerations are involved in determining whether a change of venue should be granted. They include the nature and gravity of the crime, the nature and extent of the media coverage, and other factors. He said the overriding consideration is whether a defendant can get a fair trial in the community.

The district attorney's office decided to prosecute McInerney in adult court because the law allows it for juveniles as young as 14 who are accused of serious crimes, officials said.

McInerney is scheduled to be arraigned on March 21.

Unless NASA can take you to Mars or you can show your client was legally insane at the time he committed this terrible act, your client is DONE!
This story has reached beyond the United States and around the world.
Mr. Vogel, have you been home in bed sick and dying with the TV, radio and computer turned off?
I'd see if the judge would allow you to import Aborigines from the Outback as jurors!

those classroom witnesses will show that brandon killed his bully. they will not be as biased as the media on onlookers.

Larry King was taunting the shooter over a period of time, making passes while dressed up in lipstick, mascara, high heels and otherwise "expressing himself" at the expense of the other kid - not just once, but over a period of time, with full knowledge of the administrators, causing 14-year-old leaderless, parentless Brandon great ridicule in front of his classmates - not just once, but over a period of time. Now, with Sheila Kuehl and the whole parade of homosexual political players involved in this matter and the Star picturing him with a caterpillar in his hand [ sans mascara, lipstick, et cetera ] the shooter does seem to require a somewhat more neutral bubba-less venue.

Move him wherever you want! Guilty here, guilty anywhere!!! Why move him, to cost taxpayers more money? Get real! His family should have moved him away before he committed this insane crime. Let him ROT! He'll either do it here or in hell :)
