RE: ILLEGAL ADOPTION OF JOHNNY FIVE
A424353 Pen 140 Tag BIO5
Dear Ms. Gilsbiy and Ms. Jenks,
I represent the interests of Ms. Laureena Campos in connection with the above referenced matter. Ms. Campos is the legal owner of Johnny Five, a Maltese dog picked up by your agency on Sunday, September 23, 2007. Ms. Campos has been informed that Johnny Five was "adopted" on Friday, September 28, 2007 despite the fact that Johnny Five had been identified by household members on Monday, September 24, 2007. Ms. Campos has been advised by the Police Department that this is a civil matter and her only recourse to retrieve her beloved Johnny Five is through legal action.
On Sunday, September 23, 2007, Johnny Five dug a hole under the fence and escaped from the backyard. Later that same day, Andrea Coffin, Ms. Campos' roommate, discovered that a neighbor had called the Humane Society of Ventura County to pick up Johnny Five. Unfortunately, Johnny Five had just had a shampoo and he was not wearing his ID tag when he escaped from the backyard.
The following day, Monday, September 24, 2007, Ms. Coffin, her aunt and her niece went to your agency and were greatly relieved to find Johnny Five was there. He was in Pen 140 and tagged BIO5. Ms. Coffin identified Johnny Five and attempted to bring him home. The clerk asked Ms. Coffin if she was the owner and Ms. Coffin told her the legal owner was her roommate, Laureena Campos, but that the dog lived with them in the same house. The clerk told Ms. Coffin she could only release Johnny Five to the legal owner. Ms. Coffin explained to the clerk that Ms. Campos was out of town. The clerk told Ms. Coffin that the owner had until Saturday, September 29, 2007 to retrieve the dog.
On Wednesday, September 26, Ms. Coffin returned to your agency to check on Johnny Five and make sure he was OK. Johnny Five is a member of the family and Ms. Coffin was deeply concerned that Johnny Five was being well taken care of while at your agency.
On Friday, September 28, Ms. Campos had returned from her out of town trip and went to your agency to retrieve Johnny Five. She was completely distraught to discover that Pen 140 was empty and her precious Johnny Five was no where to be found. The clerk informed her that Johnny Five had been adopted earlier that day. Ms. Campos was beside herself with grief. Johnny Five was a gift to her from her husband and she no longer has her husband. Johnny Five is all Ms. Campos has. He is more than a pet. He is like a child to her as she raised him since he was a puppy. She spoils him senselessly and loves him with all of her heart. She is devastated by the loss of her Johnny Five.
Ms. Campos has called your agency every day regarding Johnny Five. She has been informed that the new owners have said that Johnny Five is content with them. This is beside the point. Johnny Five was identified by a household member on September 23, 2007. Your agency had notice that the owner was out of town and that Ms. Campos would retrieve Johnny Five. Your agency informed Ms. Coffin that Johnny Five would remain at the shelter until Saturday, September 29, 2007. Ms. Campos arrived at your agency prior to this deadline, on Friday, September 28, 2007.
I find it ironic that your web site provides a tremendous amount of information regarding the responsibilities of a pet owner and yet you refuse to return Johnny Five to Ms. Campos when she far exceeds your requirements of protection, provision and love for her Johnny Five. Your web site in fact refers to adoptive pets as family members so I am certain you can sympathize with the pain and anguish Ms. Campos is currently experiencing.
I can assure you that Ms. Campos will seek every available remedy and proceed with legal action to obtain Johnny Five. I understand that you operate a busy agency but the adoption of Johnny Five prior to September 29, 2007 is a mistake that you can correct. I respectfully request your cooperation in returning Johnny Five to Ms. Campos without legal intervention. We can resolve this matter with your cooperation. Please consider this letter as a formal demand for the immediate return of Johnny Five to his rightful owner, Ms. Campos.
Please feel free to contact me at the above address or phone number. I would greatly appreciate the opportunity to speak to you directly regarding this matter.
Sincerely,
Kathryn M. Sowell
