A Ventura County Superior Court jury on Tuesday found a member of the Hells Angels Motorcycle Club guilty of assault with a deadly weapon likely to cause great bodily injury in connection with a bar brawl in Newbury Park.

Judge Kevin DeNoce set sentencing for Brandon Thomas Mundell for Jan. 28.

Mundell, 28, a San Fernando Valley resident, is facing nine years and four months in prison when he is sentenced, according to prosecutor Derek Malan.

Mundell, who was out on $180,000 bail, was taken into custody after the verdicts were read.

Jurors also found Mundell committed the crime for the benefit of, in association with, and at the direction of the Hells Angels. Jurors also found true that the Hells Angels are a criminal street organization.

Malan said that as far as he knows, this is only the second time that a California jury has found the Hells Angels were a criminal organization. He said the first time was in King County, where the Hells Angels' Fresno Chapter was accused of assaulting with deadly weapons another motorcycle club in that city.

Malan said in an interview that the gang-related finding against the Hells Angels by jurors is something that happens only infrequently because witnesses are afraid to testify against the club. In Mundell's trial, Malan said one witness recanted his testimony and said he didn't recall a single thing about the bar fight.

The prosecutor credited the testimony of sheriff's deputy and gang expert Jeremy Paris for convincing the jury that the Hells Angels were a criminal street gang.

The jury found Mundell guilty of driving while intoxicated after the 2006 bar brawl and injuring a Ventura County sheriff's deputy. Jurors also said Mundell's blood-alcohol level was higher than .08 percent, which is the benchmark for legal intoxication.

Mundell was found not guilty of three counts of exhibiting a weapon, a knife. Malan said in an interview that he had told the jurors during the trial to find Mundell not guilty because he believed there wasn't enough evidence beyond a reasonable doubt.

Mundell is a member of the Hells Angels' San Fernando Valley chapter, and he and two other bikers went to the now-closed Take Five Bar and got into a fight with patrons at 1:40 a.m. Jan. 19, 2006.

The prosecutor said the men went to the bar — allegedly frequented by members of a rival group, the Mongols — to challenge them to a fight. The Mongols, who are said to have a chapter in Camarillo, were apparently not at the bar that night.

Mundell's lawyer, Dino Inumerable, declined to comment.

Inumerable, however, argued during closing arguments in the trial that it was Mundell who defended himself against the bar patrons because he feared for his life.

Inumerable told jurors the prosecution wanted them to believe that his client used a four-inch knife to take over an entire bar that could have been "potentially infested" with rival gang members and that he set out to do it with the help of two bikers who weren't even Hells Angels.

Malan said Mundell is still facing similar assault with a deadly weapon charges stemming from a bar fight in Simi Valley in 2007. He said a person was stabbed and Mundell was with two Hells Angels associates.

If you even talk to a club member you are automatically an associate according to the DA. I honestly don't believe this guy would try and take on a bar full of Mongals with a 4 inch knife!

Wow....you mean those jurors were wasting their time listening to and considering all that evidence and testimony and all they had to do was ask you brilliant people? I think you should go down to the courthouse and offer your services. I mean being able to come to these conclusions with no information....This could really speed things up.

My favorite comment on this article...."Jurors also found true that the Hells Angels are a criminal street organization." WTH, they are just figuring this out! Com'on! I have been around plenty of HA's in my time and I can honestly say that I wouldn't be suprised if this idiot actually thought he could take on a bar full of Mongols with a simple knife. These guys, especially the younger prospects will do the stupidest stuff to get accepted and jacketed. Personally to me it sounds like this was a bad joke some of the older HA's were playing on this guy. Maybe he wasn't entirely liked by his club. Who knows. But why else would he be in that bar which is a known hang out for Mongols? Bada$$?

For those of you trying to defend this person, it isn't as if he were a member of a service or community group trying to better the community and world around him. He is a member of a known street gang. I think the police and courts do an amazing job and should be commended for getting one more criminal off of the streets and into jail.

The largest problem that I have is this cops testermony, These cop that are "Experts" can say anything on the stand. They are quilafeid as experts becouse they take class's given by other cops, and they read books written by other cops, the sad fact is that the courts except their story's as fact. ex. the bar is a none hangout of the Mongols, None to who? the cops. I don't blame the jury, they are given derection by the judge, but when you covict an organizion on the evidents agianest one. We should be able to convict all the police agency's for being organized crime, just by the amont of cops that are dirty.

most bar fights are fueled by alcohol, and are a "heat of the moment" type of incident. the evidence presented showed a "premeditated" act by showing up at the bar looking for trouble.

This defendant is guilty as hell. Any HA can go to court, and testify as an expert in the HA's behalf. The only problem is they will get cross examined and have to provide truthful information. That is the problem. The HA are not truthful and would never allow this to happen in the first place. Also, the cops dont read material just made by police. The HA have published many books, videos, TV episodes (A&E, True TV), etc about their history. Also there are HA informants and arrests made of HA's that show their criminal participation. With this information they have placed themselves into the criminal element. I am sure Laughlin was just a misunderstanding.....NOT! Just because the HA does toy drives doesn't mean the HA are not a criminal element. Good job to the jurors who heard this case and handed out a conviction!!!

I go to church, but I've learned not to judgee people. I've known many Bikers through the years, and I even have a friend in his 70s who was a Hell's Angel.
I think alot of these selfrighteous hypocrites don't even know who God is. Christ came and ate with sinners. He was not judgemental at all. He loved everyone equally.

Why are you so ready and willing to judge others? Does it make you feel more important? Your faults seem less severe? Day after day I see postings that don't realy discuss issues, but put others down so they can feel better about themselves and sleep at night.

Not everyone thinks the same, was raised the same, or can overcome difficulties the same. Stop trying to better yourself by focusing on others faults. Instead, look at your own and hope nobody verbally crucifies you because your not perfect.

I don't disagree with there being bad cops, I've even known a few personally. There's also bad educators, construction workers, bankers, retail clerks, clergy. etc...

If a law enforcement officer commits a crime, he's a criminal. If a Hells Angels member commits a crime, he's a criminal. Not to much gray area there.

I'm looking at the site you referenced, I also notice the publishers aren't forward with their affiliations, agenda or if it's a group or an individual. So giving them any credibility is kind of hard.

So he wasn't involved in that one either? It sounds like this guy is a habitual criminal. If this was a Mexican street gang member everyone would be saying how their all criminals. Since he's in a predominantly white gang, it's injustice? Where's the logic in that?

I know first hand of cops who lied for their brethren on the stand. They have their own 'code of silence'.

That is where I have a problem with LE on the stand-most are honest but there are some bad apples out there. Who do you think a jury will believe first?

As far as this discussion-I don't foresee any leader of the Colonia gang running the Olympic torch or collecting toys (stealing toys maybe) for area needy kids Mamaof2.

I hardly post comments on this site, but reading the above really disgusts me.. A man was found guilty by a jury of his peers of a crime, and committing the crime to benefit a criminal organization.

A jury was picked by the DA and Defense, a court proceeding was completed, and a jury made their finding based upon the evidence! It just seems there are a bunch of angry people here because a jury of 12 citizens did not favor the defendant! OJ made it work one time, so have others. It was not meant to be based upon the evidence.

And for "redridder"... just because my screen name is what it is, doesn't mean I am "The Man." You are profiling me based upon a word. I am a John Wayne fan! Think of my screen name now.

To Justus357, and Monday, My point is that if Mundall comitted a crime, HE is on trail not his friends, not his club members, He is on trail. When the DA wants to throw in passed crimes, some real, some fake, that Mundall had nothing to do with, It's wrong. Same as they do when they find a dirty Cop, they don't go after the whole police dept. Monday that web site is just reporting news articales from newspapers from around the world. Hooligan and Redridder typify the kind of apologists that the Hells Angels appreciate...the cops always lie, the DA persecutes them, and the bikers are misunderstood motorcycle enthusiasts.

Besides their horrific spelling and language useage, both of these folks appear to look for any reason to excuse the type of behavior that got Mundell in trouble in the first place. He is the one who went to a "known hangout" for another group of losers, with the intention of showing what a "man" he could be to impress the HA's.

If only the HA's, Mongols, Vagos, etc could find a place in the desert to go show off for each other, and spare the rest of us, it would be great! They could take Hooligan and Redridder along to shine their shoes, and wipe their butts for them.

I actually feel very safe in my neighborhood and the "reality" of which you write is not my reality. I feel that Ventura is a great community in which to live without the HA's "help". I feel that all gangs are a blight on humanity and each gang member is a waste of skin. Defending a gang or gang member is just beyond my realm of acceptability and bashing our hard-working police department because of a small number of officers who abuse their position is also unacceptable to me. I don't agree with your reality or your opinion, although you are indeed entitled to both. It would be easier, however, to not just brush you off as some uneducated HA supporter if your post were slightly more coherent and well-written.

I CANNOT BELIEVE THAT MY POSTING WAS REMOVED EARLIER. Ventura County houses some communist and biased people that have no interest in ones RIGHT to lead a lifestyle that may differ than their own. Brandon Mundell was tried and convicted. Fair enough. But you are talking about a BARFIGHT that may result in a young man, a young father of a little girl, to more than 9 years in prison? No one went to the hospital. No one was even hurt. That is outrageous. I will stay up in Sonoma County with the rest of the Liberal world and make sure to head down the 5 and not the 101 just so I can avoid your dogpile county. Are you going to remove this one, Staff?
