Southside Chiques injunction upheld

A court of appeal Monday upheld the gang injunction against the Southside Chiques, the second-largest criminal street gang in Oxnard.

The civil gang injunction, which was issued Oct. 23, 2006, prohibits gang members from engaging in certain conduct within a designated area.

Special Assistant District Attorney Michael Schwartz said prosecutors are pleased that the justices of the California Court of Appeal, 2nd District, Division 6, upheld the injunction.

Earlier this year, the California Supreme Court declined to hear an appeal of the civil injunction against the Colonia Chiques criminal street gang, which is the largest gang in Oxnard.

"This is the second case that a court of appeal has affirmed a gang injunction that our office has obtained against criminal street gangs in Oxnard," Schwartz said Tuesday. "I think it affirms the validity of using injunctions to help protect the community against street gangs."

Prosecutors say the Southside Chiques is active in Oxnard and Port Hueneme and has about 200 members.

Under the terms of the civil gang injunction, gang members are prohibited from certain behavior, including associating with other gang members, possessing weapons or drugs, publicly consuming alcohol or violating other laws in so-called safety zones.

The Southside Chiques injunction covers a 4.26-square-mile safety zone, some of which overlaps the existing 6.6-square-mile Colonia Chiques safety zone.

In making its Southside Chiques ruling, the justices rejected the argument that an individual who denied being a member of the gang should have been permitted to participate in the Ventura County Superior Court proceedings.

Critics of the gang injunctions say law enforcement already has all the tools it needs to fight crime. They argue that social programs are better long-term solutions.

These critics must be in la-la land! Put them in La Colonia for a week and see if they change their tune! These gang injunctions have been the best thing for Oxnard!

Social programs and gang injunctions are not mutually exclusive. They can create all of the social programs they want. Nobody claims that the injunctions are the end all be all of the gang program. PLEASE go out and start these social programs. But, DON'T intentionally hamper the efforts of law enforcement to curb gang violence while your long term social programs are still developing.

I say send them all back to Mexico and let them terrorize their own. Or, put them all on some deserted island an let them all kill each other. Send them to Iraq--Put them in boot camps. Get them the heck out of here!!!!!
They are all terrorists and should be treated as such.

Keepin it real: I am with you on that one.
I have to agree that the injunction has helped Colonia. I grew up there. Will not go back, but then where is it safe to live if Southside is just as bad. Will they injunct the whole city one day.
Northside always has issues...Does anyone know where in OXNARD Its safe?

Question for law enforcement:
Is simply being a member of a 'criminal street gang' a crime?
If yes...why not lock them all up?
If no...I guess we have to wait for them to commit a crime.
Another question:
Does "associating with other gang members" include a bunch of 'homies' gathered at someone's house watching a soccer match...all the while staying within the confines of that house? Or, do the Police just wait until they start to leave, and then bust them?
And, does "publicly consuming alcohol" include that person's back yard?
Whereas I support the injunctions, and I am happy that the court has upheld them, some of the limitations spelled out in this article ARE a little vague.

Read Section 186.20 through 33 of the California Penal Code. It is known as the "California Street Terrorism Enforcement and Prevention Act."

186.22. (a) Any person who actively participates in any criminal street gang with knowledge that its members engage in or have engaged in a pattern of criminal gang activity, and who willfully promotes, furthers, or assists in any felonious criminal conduct by members of
that gang, shall be punished by imprisonment in a county jail for a period not to exceed one year, or by imprisonment in the state prison
for 16 months, or two or three years.

That is a sample of an overly complex bunch of legalese. "...willfully promotes, furthers, or assists..." is where the meat is.

Public is not in a backyard. However, they are prohibited from associating with each other, period. Problem is, we are seeing Southside Chiques tags in East Ventura on turf that is claimed by El Campo.

Thank you nuts805--I live in a good area of Oxnard I thought, but you are right, I don't think there are any good areas in Oxnard anymore. Just simply better areas than others. Why is that?
shaver_one--good point, aren't street gangs criminals anyway? If not, maybe they should be.

I am very happy to see the court of appeals and their justices upholding this injunction. It's nice to see things work the way they were meant to work..and not bend to the pressures of the ACLU and their ding dang a doodle civil rights loopholes. Gang members need to learn (if they can) that they don't run the streets the way they would like to THINK they do. I love to see the bangers getting BANGED by the laws of this city! WHOOOO YAAAHHH!

I went to elementary school in Colonia and being a white female, it was horrific on me. Let me just say that I was the "token white child" being intergrated into that area to mix up the color lines. It sucked and I feared for my life everyday I went to school there. I can't tell you how many times the school was locked down for gang activity or suspicious activities going on. I stayed real clear of the school yard fence that faced the street and houses, I didn't want to end up a dead innocent bystander and the sad thing was; I was 11 and knew how not to get killed in that area. I bet they don't intergrate anymore into that area!

No worries Shaver...the limitations may be vague in "this article" however they are spelled out very CLEARLY in the laws that were written up specifically for this injunction...make no mistake about it.

Let me first start by saying that I am in favor of gang injunctions as a tool for law enforcememnt.

What I'm not in favor of is people misrepresenting Oxnard as an all out warzone for gang activity.

I've lived in Oxnard for roughly 25 years and spend a lot of time in and around town. Thankfully, the closest I have ever come to witnessing anything even remotely gang related was an incident at a local park in which three punks tried to start a fight with one other guy.

It only took about five minutes for all the parents to step up and shoo the little buggers out of the park. (We even got one of them to apologize on his way out. Ha.)

Point being, the crime we see in the news far outweighs the amount of crime the good people in Oxnard actually have to be worried about. And it helps when people in the community aren't afraid to stand up and remind them that it's our city too.

By the way, I've been living in the south end of town by Oxnard College for several years now and love it. No gang bangers, very little tagging, great schools and cops are actually starting to patrol nowadays.

My biggest peave is the house around the corner that's always having amplified parties. (The music aint bad until it wakes up the kids. Grrr!) How about a little consideration for your neighbors?

they need to step up the injunctions to a whole other level. make them citywide, then countywide, then statewide, etc, etc. so many of these gangs get run out of certain areas, and then end up in new neighborhoods in new cities. I know the stockton area became a hot bed for the crips from LA back in the 80's.
just castrate them if they are convicted of a gang crime. eventually, that will end the cycle, as no more of these losers will be able to breed. it is a huge cycle that is never going to end, as long as we have these lame liberal lawyers with their lame appeals going on.

It's funny how as soon as something bad comes up the solution is to always send them "Diry Illegal Mexicans" back where they came from. Do you know the satistics of Pedophiles and Kidnappers are 70% White Males. Do you hear us saying send them back to Europe or where ever they came from. Because no one is originally from America. Unless your Native American or like my family that I can trace back when the border crossed us. I'm sure know that Texas Arizona and California were TAKEN from Mexico. So think about that next time you make a comment like that. FYI Not all of us are Illegals. By the way I'm from Camarillo where my sons have to deal with kids telling them that they don't belong here. And that Mexicans are the lower race. This is what you teach your kids and trust me they let it be known. My sons are smart and yet they come home in tears sometimes. Hope your happy by passing your Tyrant blood on to your kids.

boardercrossedme--you know what? I am sorry your kids are being treated in that way, that is wrong!!! However do you think these gangs should be here terrorizing our cities? I don't think so. They are probably not working and paying taxes. They may or may not be legal citizens and if they are not legal citizens they should be sent home I never said a word about that anyway. And by the way, I married a hispanic man and that makes my son half hispanic. If this gang was from Vietnam, or from Europe I would have said the same thing. My comments were about the gang itself. If the article was about a child molester (like the one at the camarillo library) I stated to lock him up and throw away. Get him outta here too. Others and I also make a comments about a child molester in another article about what should happen to him and those comments were removed. Use your imagination on that one. If you read the other posts in this article I was not the only one who felt this way about this gang. So I ask you, are you in support of illegal citizens and gangs?

Is this not what you put???? If you would have read my comment correctly you would have understood that my only problem with your comment is that, not everyone who is in a gang is Mexican or an Illegal, even if it is a Mexican sounding gang name. No where did I put that I supported gangs or illegal's. I can't stand gang violence just as much as you can't. I can't stand the fact that everytime my husband and I try to go out to have fun at a pool hall or a club, he gets asked " Where are you from." (so stupid) I am afraid plenty of times for him because of gangs. And as for illegals I'm not a big fan of that either especially if your not paying taxes like everyone else. I believe there is a right way of doing things if you want to be here in the United States. And just for your info, because I see alot of people saying that Illegals get alot of help from welfare and Medical. i work for the county and you cannot get help if you do not have a SSN. But another interesting fact that i would like to bring up is, people crossing the Mexican border has always been a problem it seems its only now a problem to SOME people because they arent just your landscapers and your nannies. and now they are your next door neighbors. WHAT AM I DOING? WHY AM I HERE?
