Nonprofit's lawsuit against city delayed

A case that's pitted a county nonprofit affordable housing group against the city of Santa Paula has been postponed for at least another month.

On Monday, a Ventura County Superior Court judge was to hear opening arguments in the case between Cabrillo Economic Development Corp. and the city. But the judge unexpectedly removed himself from hearing the case, Santa Paula City Manager Wally Bobkiewicz said.

"He doesn't have to say why," Bobkiewicz said.

Another judge will have to be assigned to the case, review the legal briefs submitted by both sides and be ready to issue an opinion before the hearing can take place, he said.

"Our attorney said it will be at least another month," Bobkiewicz said.

The lawsuit centers on whether the Santa Paula City Council was within its rights in denying a large affordable housing development.

The case was triggered by the Santa Paula City Council's denial in August of Cabrillo's planned 150-unit Plaza Amistad development, which would include affordable homes, farmworker housing and rental units.

If they sued Fillmore and won, I wonder if Santa Paula is shakin' in their boots.

The City did not reject the project, they rejected Cabrillo's request to change the zoning so that they could reduce the amount of landscaping and push the buildings closer to the property lines. That doesn't sound very nice for family housing.
