Eminent domain timeline
1989: Moorpark City Council approves eminent domain authority, called Amendment No. 1, and sends it to a citywide vote. Moorpark voters change No. 1 to exclude residentially zoned property or any property zoned commercial or industrial that had an owner-occupied residential structure on it. The revised authority is called Amendment No. 2.
2001: On July 5, the Redevelopment Agency's eminent domain authority expires. The agency never uses its eminent domain authority in 12 years.
2005: The Redevelopment Agency initiates the process to reinstate its eminent domain authority for an additional 12 years in accordance with state law. The amendment would give the agency authority to acquire commercial, industrial and certain residential properties within the redevelopment area. Because the proposed amendment has the potential to affect low- and moderate-income households in the area, a Project Area Committee is formed. Members are elected by residents and business owners to review the proposed amendment.
2006: On June 6, the committee recommends the Redevelopment Agency reinstate its old eminent domain authority, Amendment No. 2. The committee also suggests the city consider implementing the following rules: Businesses displaced by eminent domain be compensated for all expenses and direct and indirect loss of revenue; restrict the use of eminent domain on county- or state-designated historical landmarks; do not allow the agency to spend money outside the redevelopment area; consider the area of Walnut Canyon Road and Everett Street a priority for agency spending. If the committee's suggestions are included in the agency's eminent domain authority, voter approval would be needed.
2007: On July 24, the Planning Commission adopts a resolution finding Amendment No. 2 does not affect the General Plan and recommends approval and adoption of the amendment.
