Man pleads no contest in tortoise abuse

The 40-pound African spurred tortoise was abducted July 7 from his owner's backyard, slashed and later dumped behind an apartment complex in Ventura.
After the hearing, Mosqueda's lawyer, Brian Vogel, said his client feels horrible about what happened.
"He wanted to resolve this case in the early stage of the proceedings and take responsibility for what he did," Vogel said. "There were probably some other people involved, according to witness accounts."
The plea brought Dorothy and Bill Sullivan some closure over the saga of their tortoise Bob, but now the family is dealing with a new heartache: the mystery surrounding the death of their pet dachshund.
As for the tortoise case, Ventura County Superior Court Judge Bruce Clark set the sentencing for Oct. 3. Prosecutors don't think the Ventura man will be sent to prison, but he could face jail time. Mosqueda remained in custody Wednesday in lieu of $100,000 bail.
The Sullivans attended the brief hearing with about a dozen supporters and said afterward that Mosqueda should have pleaded guilty if he was truly remorseful.
"If he really wants to get better as he claims, well, be honest and take responsibility for what you've done," Dorothy Sullivan said.
The Ventura family is now dealing with the death of their dog Flapps, who was euthanized Monday. The 12-year-old miniature dachshund may have been poisoned and police are investigating the case, as well as a series of threats the family has reported.
"My dog went from being perfectly healthy, chasing a ball, to dying in a matter of hours," Dorothy Sullivan said in an interview before the hearing.
The small pet, which is kept in the family's yard, likely ate something that could have been dipped in antifreeze or some other type of poison, the family said a veterinarian told them. An employee at the veterinarian's clinic indicated the dog showed "symptoms of ingesting antifreeze," though a necropsy, which would have cost the family $1,500, was not conducted to confirm the cause of death, Ventura Police Detective Kenny McConathy said.
Vogel said Mosqueda was sitting in jail and couldn't imagine he'd have anything to do with the Sullivan's family dog or threats against the family.
Accepting full responsibility
"I strongly doubt that he has anything to do with it," he said.
He said his client accepts full responsibility for what he's done with regard to the tortoise. "He's a young, 18-year-old kid with almost no record," he said. "He's apologized and will continue to apologize."
Both Bob and Flapps were special friends to the Sullivans' 6-year-old autistic son, William, who rarely spoke to people but often chattered to the family animals.
Police called Bob's abduction and mutilation one of the worst incidents of animal abuse in Ventura in years, and the incident garnered nationwide media attention.
Since the abduction, the Sullivans have endured a mix of emotions, their spirits boosted by Bob's slow recovery and an avalanche of support, including dozens of cards and letters and even personal checks from concerned strangers to cover Bob's steep medical bills.
But along with the well-wishes came the threats — at first, mostly phone calls from anonymous men and women urging the family to drop the charges against Mosqueda, something the couple had no authority to do.
The threats, which the family reported to police, escalated over the weekend. Sullivan found a rock in her yard with an attached note that said if she did not drop the charges she "would get one in the head." She turned the rock and the note over to police.
The rock incident followed a phone call several weeks ago where the caller told Sullivan that her "little brown dog would be next," she said.
On Tuesday, a day after Flapps had been euthanized, the latest caller said, "woof, woof" then hung up, Sullivan said.
The prognosis was grave'
The dog's health deteriorated rapidly. "Flapps' organs were shutting down, and she was in terrible pain," Sullivan said, her voice cracking. "The prognosis was grave. We had to stop the suffering, so I had to put my dog to sleep, which was beyond devastating."
Mosqueda's sister, Celia Ramirez, said Wednesday her family doesn't know anything about the death of the Sullivan dog or the threats against the Sullivans.
"We don't bother them," said Ramirez, who was in court. "We don't really care about the turtle."
Prosecutor Wendy Macfarlane said Mosqueda is facing up to three years in prison when he is sentenced, but she doubts he'll go to prison because of his record and his age. "The most he can get without going to prison is a year in the county jail and then he'll be on probation for three years."
The Sullivans now screen their calls and have started bringing Bob indoors at night. They also are taking precautions with their other animals.
"This has upset our whole lives," Sullivan said, pausing to compose herself. "It's infuriating because we have done nothing wrong. We should not be having threats and going through this. Our animals shouldn't be suffering."
Explaining the situation to their autistic son has been particularly difficult, she said. "William keeps asking me when is Flapps coming home from the hospital," Sullivan said. "Before we left, he would cover her with blankets and lay with her. He was so sweet with her. They were very close."

Is there any way people can donate to help pay for the necropsy of these poor people's dog. It's in the best interest of all pet owners to find out if someone has further victimized this family.
I really wonder what's going wrong with Ventura County. I moved here thinking it was safe here, but every time I look at the Ventura County Star site, I see more and more reasons to leave. There is something very very warped with a place where an autistic boy's pets aren't safe in their own backyard.
Isn't sadistic animal abuse a sign of sociopathic behavior? Jose "Tony" Mosqueda should be locked up for life, not facing probation. It seems obvious someone connected to him poisoned the dog. Why won't the police do something?

It's a sad state of affairs that such sick, lack of compassion maggots should inhabit the earth. The same sick treatment they gave to innocent animals should be the same type punishment meted out to them, and castrate them so they will not bring into the world more of their sickness!

What the hell is going on? Where is the expression of compassion that resides in the hearts of ALL humans that would scream STOP WHAT YOU'RE DOING? Are we morphing into evil puppets of mind, and any thought that enters our heads becomes an unavoidable command? Is resistance futile? Just drop the knife already, drop the gun, drop yourself to the ground and let the Earth begin to transform you. The time for change has come.
Why is it so hard to be soft? I'll let you know when I figure it out. Still dealing with the log in my own eye. At least I haven't resorted to carving live tortoises to medicate my human confusion. I don't see the connection of inflicting suffering on another sentient being, in a twisted attempt to ease one's own existential suffering.
Better take a good look in the mirror, for cruelty lurks within each of us and must be headed off at the pass, the seed of compassion is waiting to be watered and fed, and it's a long, long journey to Consciousness. Get to work.

Its a very terrible thing. The fear of all these threats ! It has to be either his family or some close friends. He should know who they are ! Maybe he can plea bargain for giving that info up. As in plea bargain I mean drop a week off his sentence or allow him a phone call once a month. If not then NO calls home !!!!!
My heart goes out to the Sullivans ! This has got to be a very tragic time for you all. First Bob and now your beloved dog! I really hope they catch the scum bag who is calling and making threats to your family. I would put up a surviellence system. They aren't that much. Have some senser lights. Then go to target and get the Baby system. You can also buy extra cameras to place around the house. Then just leave a VCR tape in the recorded at all times recording. IT works ! I caught a few guys that were charged with attempted murder on mine !

HELLO? VCPD- Tap her phone! Sheesh. Obveousley these calls have been going on since poor bob got hurt, there were warnings about this poor puppy - someone told her "the little brown dog is next" and then after she had to put him down, another person called and said "woof woof"..Gimme a damn break. This could have been prevented, all they would have to do is trace the call to the location. With technology these days, I cant believe they didnt do something. I know that the VCPD has more serious crimes to solve, but to us animal lovers, this is as serious as it gets. I hope they take action, and whoever is harrassing these people, STOP IT! They have gone through enough.

Thats what I was thinking...why havnt the police tapped their phones...especially with all the threats. They should even have surveillance round the clock?? I dont get it...arnt they helping this family. Sounds like the screwed up family is in on all of it!

It makes me sick that the sister says that she doesn't care about the turtle. It seems that the whole family has issues. And is it suppose to make us feel better that he has almost no record? He is only 18 he should have NO record. He needs jail time and I think his sister should learn about compassion. I feel terrible for this family. What an awful thing to have to go through. And the poor son. I just hope that somehow there will be a silver lining for this family. Whoever is doing this needs to stop and realize that the family are the victims not the loser sitting in jail

if mosqueda TRULY took responsibility for his actions, he would have plead GUILTY, instead of "NOLO CONTENDRE" (no contest). guilty ADMITS guilt in court, nolo merely means that he won't contest the charges. while the nolo plea results in a conviction, it can't be used against him in civil court, which is where he should be next. this just makes it slightly more difficult for the family to recover damages, as the case will have to be proved there, too.
annawhat, the necropsy is done after the death of an animal. that's the term they use for an autopsy.
and for all of you recommending purchasing guns, i fully support that with the caveats that:
(a)you learn how to properly and safely handle and shoot it (if you don't already know); and,
(b) you make sure to keep it safely away from children.

Lets all go to the Ventura County Superior Court for the sentencing on Oct. 3. All of us animal lovers can show support to the family and also send a message that we are not going to sit back and let our animals become victims. We are going to take action. Lets use our anger, not just in this blog.....
As far as the sister goes, when he turns on her she will finally understand.
The Sullivan family should consider a civil lawsuit, for Bob and Flapps. Sometimes jail doesn't scare these types, jail is like a gold star to them. Now money talks, make them pay for all the vet bills and pain and suffering to the family.

I'm not condoning the act when I say this, it is very disgusting and deserves extreme punishment, but this article is very one sided and biased. Its obviously using very little of all information available to turn a story into a tear jerker causing everyone to read new developments once a week.

Actually I was thinking, shouldn't the police pay for the Flapps's necropsy? The police don't make families of murder victims pay for autopsies to prove their loved ones were murdered. Obviously, this family is being targeted, the police should want to put criminals behind bars. If the dog was poisoned, that's a crime. I wonder if this scumbag, Tony Mosqueda has gang ties.

omg, i can't believe Celia Ramirez said she doesn't care about the turtle. I agree with all those that posted they don't care about her or her brother also. Some phone tapping defenetly needs to be going on here. I hope the threats to this family stop and the endangerment to the their animals.

the police don't provide autopsies of humans. that is handled by the medical examiner/coroner, which is funded by the county (our tax dollars). they only provide death analysis in human cases. it's unfortunate, but there is no system in place for public funding of necropsies on animals in these types of cases. the police agencies in the county don't have this in their budgets.
this would be a good opportunity for the humane society or the spca to step up to the plate and provide services like these, since that what's they say they exist for.

Hi, I'm one of the people involved with putting up the website to help the Sullivan's (http://justiceforbob.com). I saw Dorothy at the hearing yesterday. She is beyond devastated over the loss of her poor dog. She also showed me the bill for over $1000 in emergency costs related to her dog. The costs incurred in this entire incident have been astronomical. Between the vet bills for Bob, a security system for their home, and now the poor dog, this family have suffered beyond belief. Please help them if you can. Even a card will help! Thanks!

Due to repercussions stemming from this tragedy, the Sullivan’s are looking to relocate to a reasonably priced rental home in the Ventura or Oxnard area. Please help by keeping your eyes and ears open, and let us know if you become aware of any potential leads.
This is on their website. So sad. We all need to go on and help as well as spread the word. It is so sad that they were victimized yet they are being traeted so horribly. My heaRt breaks for this family

I'd really like to know what "almost no record" means... and he's 18 - don't pity him! Empathy is supposed to have developed in most people by the time they are 6 years old!!! If the Sullivans are reading this, I just want to tell you, my beloved box turtle "Shelly" who I got when I was 5 (my first pet) and still have 22 years later was severely injured when a couple of my pet rats excaped and chewed her up. My horrible fault and I will never forgive myself... but anyway, my point is, her injuries were severe and they heal so slowly, but with proper care, they heal well. They feel pain, no doubt (why some people think only mammals feel pain is beyond me) but their drive to live is incredible. Shelly is a trooper and 6 years later is healthy and happy as a turtle can be! Your tortoise will get through this and get past it and he and your little boy will grow together and have a happy life together once again. G-d bless you and your family and I am so sorry about your beloved dog. I believe though, in the Rainbow Bridge, and that sweet dog is now guardian angel to your son AND Bob!!!

well, so far they have only lost one pet. and it is pretty safe to say that the threats are coming from his family or friends. considering most of the threats were about the charges brought about because of this loser kid, I dont see how it would have anything to do with how good or bad they are as neighbors.
sounds like the PD needs to step up patrols in this area. I dont think the tracing of calls works as easily as everyone thinks. dont they have to be on the phone for a certain amount of time? these sound like pretty quick calls.
either way, I hope they throw the book at this loser. people like this do not deserve forgiveness or a second chance. chances are, he will only escalate from here.

Poor FLAPPS! He's in doggy heaven giving dog waves to other dogs to be on the look out for CELIA and her brother and everyone else trying to help that SICK SICK family!!! I dont believe anything that lawyer says, Jose just wants to get out so he can kill next. Dont they know that! First you mutilate animals and then you kill. Its not right. I was very happy to see fox news at 10 show a little snippet about this story. I loved that they got a good, closeup of Bob's beautiful little tortoise face. People need to see that face, look deep into it. See that a tortoise is not a rock with legs, it is as much a living, breathing being as that dog was and as any human is. He is a vertebrate and has pain sensors. He hurt, he felt what was done to him. Thank you Fox News for showing that face!

As far as I'm concerned, anyone who would inflict pain on an animal is a sadistic, disturbed individual who would not think twice about doing the same to a human; no respect for life of any kind. Throw him in jail; send him in for psychiatric evaluation with his sister. If you recall, Jeffrey Dahmer started off torturing and killing animals, before turning on people.

It's hard to keep an eye on things in the neighorhood where Bob was snatched, because there is an abandoned and boarded up house just yards from their home, which people are always in and out of all hours of the day and night... an alley which runs from the Avenue to Cedar, which is always full of people, who don't care, who sees them doing what, gunshots are heard over here on a regular basis, and people are on the streets 24x7. What has failed to be mentioned is this: To report a crime anonymously, you can simply call into the main VPD phone number 339-4400, ask to remain anonyous and report suspicious activity regularly - Unlike calling 911 which shows who you are, and your address. Unless the good people who are tired of living in fear, start getting active and making those calls, and giving police the information they need to get crime out of the neighborhood, it's just going to get worse. Everyone talks about criminals taking responsibility. That usually does not happen at all, and for sure does not happen until they get caught. And if what you see does not involve you today, and you don't call in what you see, hear and know, - then tomorrow, when it does involve you, think of the call you did not make today, which could have saved you or a loved one, all the pain and suffering of being victimized. It takes a whole village to raise a child. Along the same line, it takes a whole community to reduce crime.

I'm really annoyed by the Ventura County Star's reporting? Did the prosecutor offer a deal so this didn't go to trial? If so, why didn't the prosecutor let this go to trial and let a jury hang this SOB? Read the comment section, a jury in Ventura would have let this guy rot in prision for a very long time.

tony is not a man. he is a boy. his family has taught him some low values. sounds like the Ramirez and the Mosqueda families have all withheld information from the investigation of the crime of cruelty and now of the threats to the family and dog killing. is withholding information not a punishable crime? do we have jail cells for families? or at least some counseling to help get them on a better track?

Below is a link to the "Justice for Bob" petition to get the MAXIMUM sentence for the piece of human garbage that did this--did you know he has MANY pets of his own?--I'd hope at the VERY LEAST they would take them all away and not allow him to own any more...

The perpetrator is not actually a member of an official gang. He's just a "wanna be" gangbanger that hangs around with other "wanna be" loser friends. (probably the losers that poisoned the dog)

Oh yeah, meander - from what I was told - the "boy" who did it, lived on Cedar just up from Simpson, in the apartments by the hill, I think they are called the Ventura Valley View Apartments. And his friends and family are still around.... talking about how they don't care about things.... and I used to worry about pets in this 'hood cuz of the coyotes in the hills...

thanks for the info kind1--I plan to be in court Oct 3 to get a look at these subhumans for myself, since we're neighbors and all...and right on with the "gang" explanation, though wannabes are often worse cause they have more to prove.
didn't catch the excitement Sunday night, but the black-and-whites cruise by my place regularly.

too bad schools don't use that the way they did IQ tests back in my school days. There might be a lot more intervention, if we knew someone's tendancies, rather than how intelligent they are... Pretty accurate stuff too, if people are honest. Bet this "kid" would have been at the top of his class for hostility.

To all who want "justice" or want to make a differnce be at the hearing on Oct. 3, at 1:30 in courtroom 12, Judge Clark, is presiding. If the courtroom is packed with "Bob" supporters this will send a strong message to the judge that the communty will not stand for people who live there lives by intimidating others, and abusing animals. I have stood strong through most of this ordeal because I believe in our judicial system, and I refuse to live my life being bullied and intimidated. My family has had our lives turned upside down more than anyone can possibly understand by the Mosquedo's and his friends. I have seen my son, tortoise and sweet dog suffer unnecessarily, due to the heartless actions of others. I held Flapps in my arm as she passed, talking to her about our fun walks in the hills, as my heart broke. Flapps was my first baby, and I will miss her terribly. Flapps was a gentle little soul, as is Bob, and William. This being said, I don't want any violence to be perpetuated against the Mosquedo's. I chose to concentrate my energy on the wonderful people who have come to my home, sent me such thoughtful letters, emailed me and called me on the phone, all had been touched by Bob's story, everyone showed me such kindness, which helped me to deal with this. A community has been united, people from all walks of life have come together to bring love, and caring to a little boy and his best friend "Bob the tortoise". I have witnessed amazing acts of compassion, and altruism, all of which have touched my heart. I don't want to tarnish all the good that has come from this terrible event with any more violence. October 6th, and I just searched Mosqueda's name on StarOnLine, and did not get anything current about sentencing. Anyone know? Or another continuance? And did the Sullivans Relocate (I don't want to know WHERE, just they are SAFE)? I saw Ventura Police on their side of the street last night around 9:00 PM. I pray that all is well with them.
