Trial ordered in theft of over $1 million
Ventura County Superior Court Judge Barry Klopfer ruled Wednesday that there is enough evidence to hold Michelle Diane Williams Garcia for trial in connection with grand theft of more than $1 million from Davilyn Corp. in Oxnard.
Prosecutor Shirley Hayton said in an interview that Garcia also took money belonging to David Kasper, the owner of Davilyn, a major supplier of factory replacement spare parts to the U.S. military.
Hayton said the theft and forgery were done over a five-year period. Garcia worked at the company for 10 years.
In addition, Garcia didn't claim the money as income on her state tax returns and received false tax refunds.
Through a creative scheme of making up bogus invoices for "phantom services" and writing checks from Davilyn's checking account to herself, her family or personal creditors, Garcia took $1.2 million from the company, according to court records. Garcia had "unfettered access" to all of Davilyn's business and financial records, along with the personal records of Kasper, Davilyn's sole shareholder. Garcia also had access to the retirement plan maintained by Davilyn.
Garcia's lawyer, Richard Hanawalt, said in an interview that Kasper and his team of "legal eagles" went to Garcia's house after the losses and quickly had her sign her house over to them. He questioned how much Garcia owes the company and whether its insurance covered these losses.
