Fillmore to block use of eminent domain

Fillmore is set to affirm its policy against using eminent domain to acquire private property in the city's redevelopment area, officials said Wednesday.

The City Council introduced an ordinance Tuesday night to prohibit the Fillmore Redevelopment Agency from exercising eminent domain in the Central City Redevelopment Project area, the only redevelopment plan adopted by the city.

The vote was 3-0, with members Laurie Hernandez and Steve Conaway absent. The City Council members are the board members of the redevelopment agency.

City officials said they expect the council to approve the ordinance June 12 to comply with a new state law that requires redevelopment agencies to spell out their eminent-domain programs.

The law, passed last year, applies to agencies that have adopted a redevelopment plan on or before Jan. 1.

The Fillmore ordinance states the agency will have "no power" to obtain real property with eminent domain.

"It's been the direction of (the) council that that is just not a power the agency is going to have within the city, period," city Resource Manager Bill Bartels said.

When a government agency uses eminent domain, it has the right to acquire private property for public use and compensate property owners.

The ordinance would not allow the agency to add the power of eminent domain to its authority without holding a public hearing for people within the redevelopment area, among other requirements.

The agency is not looking to have power of eminent domain, Bartels said.
