Accused killer pleads not guilty in death
An Oxnard man accused of the May 6 stabbing death Juan Jose Zarate was in court on Monday.
A judge set Ernesto Gracia's next court hearing for Sept. 6.
Gracia has pleaded not guilty. He is charged with murdering Zarate, 32, of Oxnard outside a business in the 1200 block of Saviers Road about 10 p.m.
Gracia , 29, was arrested June 8 and is in custody in lieu of a $500,000 bail.
Witnesses told police that Zarate, of Oxnard, and Gracia were arguing when Gracia stabbed Zarate in the chest.
Gracia is also charged with using a knife while committing the murder, according to court records.
He has a prior felony conviction for forgery in 2005, and in 2007 he was convicted of battery on a police officer, a misdemeanor. Gracia pleaded guilty in 2004 to resisting, obstructing or delaying a peace officer — a misdemeanor.

he has all this against him, and he is not in jail??? why should we be surprised that he actually killed someone this time? it was only a matter of time.
assault on a police officer should be a felony anyways.
